1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and DAGAR Ltd (SIA), Riga, Latvia ("CrossAware", "we", "us"). By creating an account, joining our waitlist, or using the CrossAware application or website, you accept these Terms. If you do not agree with them, please do not use the service.

2. The service

CrossAware is a safety-assistance application. It detects your proximity to mapped danger zones — railway crossings, dangerous intersections and similar locations, currently in Riga, Latvia — and automatically reduces or pauses media audio on your device so that you can hear approaching trains, trams and traffic. The service includes the mobile application, the crossaware.com website, the interactive demo, and related features we may add over time.

3. Important safety disclaimer

CrossAware is an assistance tool, NOT a safety guarantee. It does not replace your own attention, traffic rules, signals, barriers or common sense. Alerts depend on GPS accuracy, your device's settings, battery-management behaviour and the coverage of our zone database, and may occasionally be late, missed, or triggered in error. You remain fully responsible for your own safety and for observing all traffic regulations at all times, whether or not the app produces an alert.

4. Accounts

You must provide a valid e-mail address and keep your login credentials secure; you are responsible for activity under your account. Users under 16 years of age require a parent's or guardian's consent, requested during signup. Parents purchasing Family plans confirm they are authorised to create accounts for their family members.

5. Subscriptions, payments and refunds

New users receive a 7-day free trial from activation. Paid plans are billed monthly or annually in advance through our payment processor (Stripe) or the relevant app store, at the prices shown before purchase. Subscriptions renew automatically until cancelled; you can cancel at any time in the app or your app-store settings, and access continues until the end of the period already paid. If you are an EU consumer, you have a statutory 14-day right of withdrawal: by starting to use the service during this period you consent to immediate performance, and if you withdraw within the 14 days we refund the unused portion pro rata.

6. Required device permissions

The app requires background location access and audio/notification control to perform its core function. If you deny these permissions the safety features cannot operate. Your location is processed exclusively on your device, as described in our Privacy Policy, which forms part of these Terms.

The CrossAware application, website, brand, design, and the structure and contents of our danger-zone database are the property of DAGAR Ltd. You receive a personal, non-exclusive, non-transferable, revocable licence to use the service for its intended purpose. All rights not expressly granted are reserved.

9. Limitation of liability

To the maximum extent permitted by law, CrossAware's total aggregate liability for any claims arising out of or relating to the service is limited to the amount you paid us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental or consequential damages. Nothing in these Terms limits or excludes liability that cannot be limited under Latvian or EU consumer-protection law, including liability for damage caused by gross negligence or intent, or your statutory warranty rights as a consumer.

10. Termination

You may stop using the service and delete your account at any time in the app or by e-mailing hello@crossaware.com. We may suspend or terminate accounts that materially violate these Terms, giving notice where reasonably possible. Sections 3, 8, 9 and 12 survive termination.

11. Changes to these Terms

We may update these Terms as the product evolves. For material changes we will give at least 14 days' notice in the app or by e-mail before the new Terms take effect. Continued use after the effective date constitutes acceptance; if you disagree, your remedy is to cancel and stop using the service.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Latvia. Disputes shall be resolved by the competent courts of Latvia. If you are an EU consumer, you retain all mandatory protections of the law of your country of residence and may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
